TERMS AND CONDITIONS OF USE OF THE ONLINE STORE

INTRODUCTION

These Terms and Conditions govern the use of the Groverdi website (hereinafter referred to as "the Online Store") and the purchase of products available therein.

These conditions are agreed between Vitaverdi, Lda, with NIPC: PT513 445 536, headquartered at Caminho da Faia n.º 9, Gaula, Santa Cruz, on the island of Madeira, Portugal, owner of the brand Groverdi, and the legal persons who wish to place an order or request a quotation through our Online Store, hereinafter referred to as "Customer" or "User".

By using the Online Store, the User agrees to comply with these Terms and Conditions. If the User does not agree to these Terms and Conditions, they should refrain from using the Online Store.

DEFINITIONS

  • "Online Store": refers to the website [www.groverdi.com]

  • "User": any person who accesses the Online Store, whether registered or not.

  • "Customer": a person who makes a purchase on the Online Store.

  • "Products": include, but are not limited to, live plants and other equipment available for purchase on the Online Store.

PURCHASE OF PRODUCTS AND DELIVERY

  • The Customer may purchase or request a quotation of the Products available on the Online Store.

  • The prices of the Products are stated on the Online Store and include VAT at the applicable legal rate.

  • The Customer must provide accurate and complete information during the purchasing process.

  • The payment method will be determined by mutual agreement between the parties once the order/quote request has been confirmed as a purchase.

DELIVERY

The Products will be delivered to the address provided by the Customer, contingent upon availability, and with the option to choose your preferred delivery method from the following three choices:

  • Pickup at the facilities - No additional costs apply.

  • Delivery to Madeira Island - Additional charges may apply.

  • Delivery outside Madeira Island - This option is subject to a quotation, as we will determine the best solution for the customer.

PRODUCT STOCK

  • Some of the Products available on the Online Store may be subject to advance ordering due to their nature.

  • The Customer will be informed of the estimated delivery time for Products subject to advance ordering.

  • The Online Store reserves the right to cancel the order and refund the Customer if it is unable to provide the ordered Product.

RETURNS AND REFUNDS

  • The Customer has the right to return the Products purchased on the Online Store within 14 days of receipt, provided that the Products are in perfect condition and in their original packaging.

  • The cost of return is the responsibility of the Customer, except if the Products are damaged or non-compliant.

  • There are items that, due to their nature, may not be accepted for returns/exchanges.
    • The customer should be aware that in the case of purchasing live plants, their vitality may be affected after transportation. The customer should follow the maintenance instructions upon receiving the live plant.


  • Upon receipt and unpacking, check for any visible damage that may have been caused during transport. If the article has any damage, it should not be accepted. After signing the transport guide, GROVERDI is not responsible for any physical damage caused by transportation.

  • For this purpose, the customer should inform via email at sales@groverdi.com, with evidence of damage upon delivery, the user should follow the instructions given by the Online Store team for the return.

  • The refund will be made upon receipt of the returned product.


INTELLECTUAL PROPERTY

All intellectual property rights, including images, descriptions, and product information, are the property of Groverdi or its partners and protected by applicable intellectual property laws.

CHANGES TO TERMS AND CONDITIONS

The Online Store reserves the right to modify these Terms and Conditions at any time. Changes will take effect upon publication on the Online Store.

In accordance with what is stated in above, any errors, defects in products, or distortion of the message (including writing errors) are excepted, in terms and for the purposes of the provisions of paragraphs a) and b) of article 33.º, no. 2 of DL No. 7/2004, of January 7.
