Terms and Conditions of Sale

1. General Information
GROVERDI is owned by the company VITAVERDI, with tax number (NIF) 513 445 536, headquartered at Caminho da Faia No. 9, 9100‑018 Gaula, Madeira, Portugal.
By accessing the website or placing an order, the Customer declares that they have read, understood, and fully accept these Terms and Conditions of Sale.
These Terms apply to all orders placed through the online store, unless otherwise agreed in writing.

2. Products and Descriptions
GROVERDI sells live plants and other small‑scale horticultural and agricultural products.
Plants are living beings — natural variations in size, shape, color, growth, and vigor are normal and expected.
Such variations do not constitute a defect, nor grounds for complaint or return.
The photographs and descriptions presented on the website are for illustrative purposes only and may not correspond exactly to the product shipped.
The Customer is responsible for verifying whether each product is suitable for local conditions. GROVERDI accepts no responsibility for unsuitable choices made by the Customer.

3. Prices, Costs, and Invoicing
All prices are shown in Euros (€) and include VAT at the legal rate in force.
Shipping costs are calculated automatically at checkout, according to weight, dimensions, product type, and destination. The Customer can view the total amount (including shipping) before confirming the purchase.
Prices, campaigns, and promotions may be changed at any time without prior notice, without affecting orders already paid or confirmed.
Invoices are issued based on the details provided at the time of purchase. Requests for changes or corrections after issuance may not be possible or may require additional procedures in accordance with tax law.

4. Payment
Accepted payment methods:
Credit card (Visa, Mastercard, American Express)

Coinbase
Payments by card, Link, or Google Pay are processed by Stripe or Coinbase. Card details are not stored by GROVERDI.
Customers wishing to pay by bank transfer must request the bank details in advance at info@groverdi.com.
Orders will only be prepared and shipped after payment confirmation.

5. Shipping and Delivery
Shipments are made through CTT – Correios de Portugal. By completing the purchase, the Customer also accepts the transport conditions of CTT.
The delivery times indicated on the website are for guidance only and count from payment confirmation, excluding weekends, holidays, or delays caused by force majeure or third parties.
GROVERDI’s responsibility ends once the order is handed over to CTT. From that point, any delays, losses, or transport damages are the carrier’s responsibility.
Transport stress in live plants — such as partial leaf loss, slight dehydration, small breaks, color changes, or initial wilting — is considered normal as long as the plant remains viable. Such situations do not constitute defects or grounds for return.

6. Receipt and Inspection
At the time of delivery, the Customer must inspect the packaging and contents immediately.
In case of visible damage, the Customer must:
Record the occurrence with the courier.
Note any reservations on the delivery receipt (if possible).
Photograph the packaging and products.
Claims for packaging damage or visible product damage must be sent within 24 hours of receipt by email to info@groverdi.com, attaching clear photographs of the packaging and contents.
Claims submitted after this deadline may not be accepted.

7. Right of Withdrawal (Non‑Perishable Items)
For non‑perishable goods, the Customer has 14 days from the date of receipt to withdraw from the purchase without justification, under applicable law.
To exercise this right, the Customer must:
Write to info@groverdi.com;
Indicate the order number and items to be returned.
Products must be returned in perfect condition, in the original or equivalent intact packaging, including all accessories, tags, and documentation.
Return shipping costs are borne by the Customer.
Refunds will be processed within a maximum of 14 days after the returned products are received and verified.
The refunded amount does not include initial shipping costs.
The legal guarantee of conformity applies under Portuguese and European law, without prejudice to any additional commercial warranties from the manufacturer.
As a general rule, repair or replacement of goods under warranty will be carried out within 30 days, except in cases of special complexity.

8. Plant Viability Guarantee
GROVERDI offers a commercial viability guarantee of 2 days from the date of receipt.
For visible damage upon delivery (damaged packaging, evident breakage), the claim period is 1 day after receipt.
Procedure:
Send an email to info@groverdi.com within the relevant period.
Attach clear photos of the plant, pot, and packaging.

After analysis, GROVERDI may offer replacement, credit, or partial refund, whenever it is determined that the issue did not result from improper conditions or negligence by the Customer.
Claims submitted after the indicated deadlines may be refused.

9. Limited Liability
GROVERDI is not liable for:
Natural variations between photographs and the delivered product;
Unsuitability of plants to the Customer’s climate, soil, or maintenance conditions;
Delays, damage, or loss during transport (responsibility of CTT);
Pests, diseases, or damage occurring after receipt;
Death of plants after the 2‑day commercial guarantee period, or 7 days when specifically stated.
In any case, GROVERDI’s maximum liability is limited to the amount paid by the Customer for the order, excluding shipping or indirect damages.

10. Data Protection
The personal data provided by the Customer are used exclusively for:
Processing and shipping orders;
Communicating order status;
Managing invoicing and legal obligations.
Data processing is carried out in compliance with the General Data Protection Regulation (GDPR).
The Customer may request access to, correction, or deletion of their data by contacting info@groverdi.com.

11. Governing Law and Dispute Resolution
These Terms and Conditions are governed by Portuguese law.
In case of dispute, the Customer should first seek an amicable resolution by contacting info@groverdi.com. If no agreement is reached, Portuguese courts shall have jurisdiction.
